more than wine SA is a limited company under Swiss law, based in Lausanne and registered with the Commercial Register of the Canton of Vaud under the number CHE-373.856.317.
When a customer (hereinafter referred to as the Customer) places an order with more than wine SA on the website www.more-than-wine.com (hereinafter referred to as the Site), he or she accepts the following General Terms of Service (hereinafter referred to as the TOS).
The purpose of these TOS is to define the conditions under which the products marketed by more than wine SA are sold to the Customer, on the Site. They detail the different stages of the sale, from the confirmation of the order to the delivery of the product(s) to the Customer.
By browsing the Site and placing an order on it, the Customer certifies that he/she is of legal age to purchase and consume alcohol in Switzerland, i.e. 18 years old.
By browsing the Site, the Customer accepts the privacy and personal data management policy, as well as the cookie management policy.
The products offered for sale by more than wine SA are those that are online at the time the Customer consults the Site. A detailed description of the product, as well as a photo, allow the Customer to describe the product. Particular care is taken to describe the products sold on the Site as accurately as possible. However, the information published is not contractual, and it is possible that the photo illustrates a different vintage or a different wine, and more than wine SA cannot be held responsible for any errors published in the description of a product. In the event of a noticeable error in a description, more than wine SA shall inform the Customer before the order is confirmed and the Customer shall have the right to modify all or part of the order.
The availability of the various products is subject to a sale in the meantime and subject to verification by more than wine SA, which is only confirmed once the order has been confirmed to the Customer. In case of non-availability of a product displayed online, more than wine SA will inform the Customer before the confirmation of the order, the right is reserved to the Customer to modify all or part of the rest of the order.
more than wine SA reserves the right to limit the availability of certain products, either per order or per customer.
The prices of the products are displayed in Swiss francs (CHF) and are inclusive of all taxes according to the law in force at the time of the order (VAT at 2.5% or 7.7% depending on the product class), ex our warehouse in Zurich. The prices applied, depending on any offers, discounts or coupons, are those confirmed to the customer at the time of order confirmation.
The delivery costs, invoiced in addition, except in special cases, are detailed in the Delivery Conditions, and clearly indicated to the Customer before the confirmation of the order.
By placing an order, the Customer accepts the costs and conditions of delivery as detailed in the Delivery Conditions section.
All orders are payable in advance.
Orders are validated once the payment is received and the confirmation email is sent to the customer. In case of delay in payment or problems related to collection, more than wine SA reserves the right to cancel all or part of an order.
The Customer has the option of paying for the order online, using the payment methods offered, the transaction being carried out through our payment service providers, Datatrans AG, SIX Payment Services SA and PostFinance SA. The validation of the order is subject to the acceptance and validation of the payment by these organisations.
The online payment is subject to the acceptance by the Customer of the terms of use specific to the various payment methods and providers.
Transactions made online are 100% secure and all data is fully encrypted and protected. The responsibility for the process lies with our financial partners mentioned above.
In case of payment of the order by bank transfer, the Customer is obliged to make the transfer within a maximum of 24 hours, and the payment of the order is due within a maximum of 2 (two) working days (excluding weekends and public holidays), otherwise more than wine SA reserves the right to cancel the order or part of it.
The choice of payment by bank transfer may result in additional delays in order processing, shipping and delivery date.
Our bank details are provided to the Customer during the ordering process.
In accordance with Swiss law on the subject, no right or period of withdrawal is provided, any order placed on the Site is considered final and definitive once the payment of it validated.
Upon receipt of the delivery, the Customer is required to verify the conformity of his order and the products received. By default, the order is considered to be accepted and validated upon signature of the receipt by our delivery person or service provider.
Any anomaly concerning the delivery must be notified to more than wine SA, by mail or e-mail, as soon as possible, in particular:
- damaged package
- missing item(s)
- broken or damaged item(s)
- item(s) not conforming to the order
After a period of 72 hours following the receipt of the order by the Customer, no further claims can be accepted.
In the event of an error in the preparation of the order, missing, damaged or non-conforming products, all costs for returns and replacements are at the expense of more than wine SA, which undertakes to correct any errors as soon as possible, subject to availability of stock.
In case of abnormal or abusive complaints, more than wine SA reserves the right to refuse any further orders from the customer.
In case of corked wine, a replacement bottle is possible in our store in Zurich, free of charge, upon presentation of the bottle and the original cork. If the same wine is no longer available, the customer will be offered a similar alternative.
Any other alterations to a wine are not eligible for a replacement bottle.
The placing of an order on the Site implies the knowledge and acceptance of the various factors in force on the Internet network, in particular with regard to technical performance, response times, connection times, queries or transfers of information, risks of interruption, risks of contamination by a virus circulating on the network and in general all the risks associated with the use of the Internet network.
more than wine SA cannot be held responsible for any direct or indirect damage resulting from misuse or incident related to the use of the computer, access to the Internet, maintenance or malfunctioning of the servers, telephone line or any other technical connection, as the customer's connection to the site is under his sole responsibility.
more than wine SA cannot be held responsible for delivery errors, delivery times that are longer than normal, or delivery times that exceed the time indicated to the customer at the time of the order, if these errors or delays are due to Force Majeure, i.e. external, unforeseeable and irresistible events.
In particular, it is possible that delivery times may be abnormally extended in the event of a pandemic or epidemic affecting the country and in the case of any restrictive measures imposed by the Swiss Confederation in the context of such events.
If any provision of these TOS is declared invalid, illegal or unenforceable by a court decision, the remaining provisions of these TOS shall remain in force.
These TOS are in accordance with Swiss law and the relevant provisions of the Swiss Code of Obligations. In the event of a dispute, the customer may contact more than wine AG. All disputes arising from an order placed with more than wine SA on this website are exclusively subject to Swiss law, the sole place of jurisdiction being the company's headquarters in Lausanne (Vaud).
